You'll have noted that the judge told them they could convict for murder even if he wasn't present, so I guess they decided it was a redundant charge. Perhaps the prosecution reckoned they didn't need the safety-net and losing it would give them a better chance of a conviction on the main charge. You're the one with the London legal friends, though . . .
